Your rights

You have the right to:

• Get a copy of your health information. You may ask to inspect or obtain a copy of your medical and health information, subject to applicable law.
• Ask us to correct your health information. You may request an amendment to information you believe is incorrect or incomplete.
• Request confidential communications. You may ask us to contact you in a particular way or at a particular location.
• Ask us to limit what we use or share. You may request restrictions on certain uses or disclosures of your health information. We are not required to agree to every request.
• Ask for a list of certain disclosures. You may request information about certain disclosures of your health information made during the six years before your request.
• Get a copy of this notice. You may request a paper copy of this notice at any time, even if you have agreed to receive it electronically.
• Choose someone to act for you. If someone is legally authorized to act on your behalf, that person may exercise your privacy rights.
• File a complaint. You may complain to us or to the U.S. Department of Health and Human Services Office for Civil Rights if you believe your privacy rights have been violated.

We will not retaliate against you for filing a privacy complaint.

How we may use and disclose your health information

We may use or disclose your protected health information without your written authorization when permitted or required by law. Common examples include:

For treatment

We may use or share your health information to provide, coordinate, or manage your mental health care. This may include consultation or coordination with other health care professionals involved in your care when permitted by law.

For payment

We may use or disclose your health information to obtain payment for services. This may include submitting claims to your health insurance plan or providing information needed to determine eligibility, coverage, or payment.

For health care operations

We may use or disclose your health information as necessary to operate the practice, improve the quality of services, conduct administrative activities, and perform other activities permitted under HIPAA.

As required by law

We may disclose health information when federal, state, or local law requires us to do so.

For public health and safety

We may disclose information when permitted by law for certain public health activities, to prevent or lessen a serious and imminent threat to health or safety, or for other legally authorized safety purposes.

For judicial and administrative proceedings

We may disclose health information when authorized or required by applicable law, including in response to a court or administrative order or other lawful process.

For law enforcement

We may disclose health information to law enforcement when permitted or required by applicable law.

For workers’ compensation

We may disclose health information as necessary to comply with workers’ compensation laws and other applicable legal requirements.

Other uses and disclosures

Some uses and disclosures of protected health information require your written authorization. These may include certain uses of psychotherapy notes, certain marketing activities, and disclosures involving the sale of protected health information.

If you provide written authorization, you may revoke that authorization in writing at any time to the extent permitted by law. Revocation does not affect actions already taken based on the authorization.

Your choices

You may have choices about how certain health information is shared. When applicable, we may ask whether you want us to share information with a person involved in your care or payment for your care, or for disaster-relief purposes.

We will follow applicable federal and Colorado law when determining whether information may be disclosed and what information may be shared.

Substance use disorder records

Certain records concerning substance use disorder treatment may receive additional protection under federal law, including 42 CFR Part 2.

Where Part 2 applies, we will use and disclose those records in accordance with applicable federal requirements. A separate written authorization may be required for some uses or disclosures of Part 2 records.

Part 2 records may not be used in a proceeding against you without your consent or as otherwise permitted by applicable federal law.

Colorado confidentiality requirements

Colorado law provides additional confidentiality protections for communications and mental health information in circumstances established by law. We will comply with applicable Colorado confidentiality and privilege requirements in addition to federal privacy requirements.

Nothing in this notice is intended to expand or restrict a disclosure that is otherwise prohibited or required by applicable law.

Our responsibilities

• We are required by law to maintain the privacy and security of your protected health information.
• We will provide you with this notice describing our legal duties and privacy practices.
• We will follow the privacy practices described in the current version of this notice.
• We will notify you as required by law if a breach occurs that may have compromised the privacy or security of your protected health information.
• We will not use or disclose your health information other than as described in this notice or otherwise permitted or required by law, unless you provide written authorization.

Website, email, and electronic communication

This website provides general information about Musician Therapy Studio and provides ways to contact the practice and request or schedule services.

Information submitted through ordinary website forms, email, or other electronic communication may not have the same protections as information transmitted through a secure patient portal or other HIPAA-compliant system. Please avoid sending detailed or highly sensitive health information through ordinary email or website forms unless you have been instructed to do so.

Scheduling and other third-party services may have their own privacy practices and terms of use. Those services may collect information necessary to provide their services.

Records

Client records are maintained in accordance with applicable federal and Colorado requirements. Colorado’s professional counselor rules generally require licensed professional counselors to retain client records for seven years from termination of services or the date of last contact, whichever is later, with additional requirements for records involving minors.

Changes to this notice

We may change the terms of this notice. Changes may apply to all protected health information we maintain. When required by law, we will make the revised notice available on our website and in other required ways.

You may file a complaint with Musician Therapy Studio using the contact information above. You may also file a complaint with the U.S. Department of Health and Human Services Office for Civil Rights.

You will not be retaliated against for filing a complaint.
