Who We Are

Musician Therapy Studio is the trade name used by Talks with Sabrina PLLC for mental health therapy services. Sabrina Merz is a Colorado Licensed Professional Counselor (LPC).

In this notice, “we,” “us,” and “our” refer to Talks with Sabrina PLLC and Musician Therapy Studio. “You” refers to the person receiving services.

Your Health Information Rights

You have certain rights regarding the protected health information we maintain about you. These include:

• Get a copy of your records. You can request to inspect or obtain a copy of your protected health information, subject to applicable law.
• Request a correction. You can ask us to correct health information you believe is inaccurate or incomplete.
• Request confidential communications. You can ask us to contact you in a particular way or at a particular location.
• Request restrictions. You can ask us to limit how we use or disclose certain health information. We are not required to agree to every request.
• Request an accounting. You can ask for a list of certain disclosures of your health information made for purposes other than treatment, payment, and health care operations, subject to legal exceptions.
• Get a copy of this notice. You may request a paper or electronic copy of this notice at any time.
• Choose someone to act for you. If you have given someone medical power of attorney or if someone is your legal representative, that person may exercise rights on your behalf, subject to applicable law.
• File a complaint. You can complain to us or to the U.S. Department of Health and Human Services Office for Civil Rights if you believe your privacy rights have been violated. You will not be penalized or retaliated against for filing a complaint.

How We May Use and Disclose Your Information

Treatment

We may use or disclose your health information to provide, coordinate, or manage your mental health treatment and related services.

Payment

We may use or disclose health information to obtain payment for services, including communicating with insurance plans or other entities responsible for payment.

Health Care Operations

We may use or disclose health information as necessary for health care operations, such as quality assessment, business management, administrative activities, and other activities permitted by law.

When Required by Law

We may use or disclose your health information when required to do so by federal, state, or local law.

Public Health and Safety

We may disclose information when permitted or required for certain public health purposes, to prevent or lessen a serious and imminent threat to health or safety, or in other circumstances specifically permitted by law.

Judicial and Administrative Proceedings

We may disclose health information in response to certain court orders, administrative proceedings, subpoenas, or other lawful processes when the applicable legal requirements are satisfied.

Law Enforcement

We may disclose health information to law enforcement when permitted or required by applicable law.

Workers’ Compensation

We may disclose health information as authorized by and to the extent necessary to comply with workers’ compensation laws and similar programs.

Uses Requiring Your Authorization

Certain uses and disclosures of your protected health information require your written authorization. When authorization is required, you may generally revoke that authorization in writing, except to the extent action has already been taken based on it.

We will not use or disclose your protected health information for purposes requiring authorization unless you have provided that authorization or another legal basis applies.

We do not sell your protected health information. We do not use protected health information for marketing without the authorization required by law.

Substance Use Disorder Records

Records relating to substance use disorder treatment may receive additional protections under federal law, including 42 CFR Part 2, when applicable. We will follow the confidentiality requirements that apply to those records.

Colorado Confidentiality Requirements

Mental health information may also be protected by Colorado law and professional confidentiality requirements. These protections may apply in addition to federal privacy requirements.

There are limited circumstances in which disclosure may be permitted or required, including situations involving serious safety concerns, abuse or neglect reporting, court processes, or other circumstances established by law.

Our Responsibilities

We are required by law to maintain the privacy of protected health information, provide you with this notice describing our legal duties and privacy practices, and follow the terms of the notice currently in effect.

We reserve the right to change our privacy practices and this notice. If we make a material change, the revised notice will be made available as required by law.

Electronic Communication and This Website

Email, online scheduling, and other electronic communication may involve privacy and security risks. Please avoid sending highly sensitive clinical information through ordinary email or website contact forms unless we have specifically instructed you to do so.

Information submitted through this website may be handled differently from protected health information maintained as part of your clinical record. The website is intended to provide information about services and facilitate contact, not to provide emergency or crisis care.

Records

Clinical records are maintained and retained in accordance with applicable federal and Colorado requirements and professional standards.

If you have questions about this notice or would like to exercise one of your privacy rights, please contact us.

You may also file a complaint with the U.S. Department of Health and Human Services, Office for Civil Rights. You will not be penalized or retaliated against for filing a complaint.
